Palestine Action judicial review to go ahead

A judicial review of the UK government’s decision to proscribe Palestine Action will go ahead following a court ruling.

The Court of Appeal in London on Friday dismissed an attempt by lawyers from the Home Office to prevent the case from being heard, upholding a previous ruling of the High Court.

The Home Office argued that a judicial review was not necessary as there is a statutory process to apply for deproscription, together with a right of appeal to to the Proscribed Organisations Appeal Commission (POAC).

However, Lady Carr ruled that this is “not an available, nor in any event an adequate, alternative remedy to a claim for judicial review of the initial decision to add an organisation to the list of proscribed organisations”.

Irish lawyer Blinne Ní Ghrálaigh KC is part of the legal team representing Huda Ammori, one of the founders of Palestine Action, who is taking the case against the UK government.

Palestine Action was added to the list of proscribed organisations under the Terrorism Act 2000 after members of the group damaged two British military planes by spraying them with red paint in protest of the UK’s military support for Israel.

Amnesty International, which opposes the group’s proscription, has welcomed the court ruling.

“It is welcome news that the court has upheld the decision for the judicial review to go ahead,” Amnesty UK’s director of campaigns and communications, Kerry Moscogiuri, said.

“There are serious human rights concerns around the proscription decision and the consequences it has had on free speech and assembly rights.

“Amnesty International UK and Liberty will be intervening in the case to raise our urgent concerns about the disproportionate use of the government’s terrorism powers in proscribing Palestine Action.

“It is clearly in the public interest for the proscription decision to be subject to full judicial scrutiny.”
