Northern Ireland woman awarded nearly £88k after unfair dismissal

A woman who was unfairly dismissed by a packaging manufacturer has been awarded nearly £88,000 by the Industrial Tribunal of Northern Ireland.
Rosaleen Conway was employed by JMC Packaging Limited from 1 June 2022 until 20 October 2023, initially as chief financial officer and later as finance director.
The respondent company claimed that Ms Conway had resigned her employment after telling the managing director: “I can’t take this anymore, I have to go before I end up falling out with you.”
However, Employment Judge Orla Murray said the words “were not unambiguous words of resignation” and the managing director’s account of events lacked credibility.
Judge Murray found that Ms Conway was constructively dismissed and that her dismissal was unfair, with no potentially fair reason for dismissal put forward by the respondent.
Ms Conway was awarded total compensation of £87,896.41.
