NI: Human Rights Act repeal 'likely' to breach Good Friday Agreement

An independent report prepared by KRW Law and Doughty Street Chambers concludes that the repeal of the Human Rights Act is likely to breach the Good Friday Agreement.

The report was commissioned by the European United Left/Nordic Green Left (GUE/NGL) group in the European Parliament.

It concludes that the “limited information which is available gives rise to grave concerns” and that the “factual and legal rationale for the proposal to scrap the HRA is flawed”.

The report adds: “In respect of the North of Ireland, it appears likely on the current proposals that reform of the HRA would breach the GFA or at least demonstrate an unwillingness on the part of the British Government to act compatibly in good faith with its obligations therein.

“This would not only jeopardise the peace process in Northern Ireland, but may entail violation of the UK’s obligations to Ireland under international law.”

The report says further analysis will be necessary once there is a clear model, consultation structure and timetable for the Act’s repeal and replacement.

Promoting civil liberties and an equality agenda, is central to this area of practice and we provide proactive advice, guidance and representation, for people who through their life experience must deal with these agencies.”
