William Fry wins construction adjudication case before High Court

William Fry LLP has acted for Timber Frame Ireland in its successful defence before the Irish High Court of an application to enforce an adjudicator’s award.
The significant judgment in MCA Connaughton v Timber Frame Products Ireland [2025] IEHC 469 was secured by a cross-departmental team led by projects and construction partner Jarleth Heneghan and litigation and investigations partner Gerard James.
Consultant Cassandra Byrne and associate Eilis Quinlivan provided support on the case.
Patricia Hill BL appeared before the High Court for the respondent.
“The decision is only the second time an application to enforce an adjudicator’s award has been successfully resisted before the Irish courts since 2016,” William Fry said in a statement.
“This judgment represents a significant development in the High Court’s interpretation of the Construction Contracts Act 2013 and the scope of payment disputes in respect of the statutory adjudication process.”
