Social housing tenant barred from using gym awarded €2,500 by WRC
A social housing tenant has been awarded €2,500 by the Workplace Relations Commission (WRC) after she was barred from using an on-site gym at her apartment complex because she was a social housing tenant.
The tenant, Agnieszka Agnieszka Nowakowska, was placed in the apartment complex as a social housing tenant last year. Her complaint arose in July of 2025 when she noticed other tenants using a key fob to enter the gym and queried with a security guard whether access was included as part of the management fees. The security guard allegedly told her that she was not permitted to use the gym as she resided in the social housing block.
Following this Ms Nowakowska raised a query with the complex’s property management company, Dillon Marshall Property Consultants, by email then via registered letter. Neither were responded to. She subsequently took a case to the WRC under the Equal Status Act 2000. Dillon Marshall did not attend the hearing.
In giving her decision that the complaint was “well founded” WRC adjudication officer, Niamh O’Carroll, stated that the denial of access to the gym constituted discrimination on the housing assistance ground and Ms Nowakowska “should have been afforded the same opportunity to access and use the gym facilities as any other tenant”. She directed a payment of €2,500 to Ms Nowakowska for breach of the Act.
