Draft findings suggest Ireland in breach of Aarhus Convention

Ireland is in breach of the binding Aarhus Convention because of the length of appeal proceedings related to rejected Access to Information on the Environment (AIE) requests, draft findings suggest.

The findings from the Aarhus Convention Compliance Committee (ACCC) were published following a complaint from solicitor Fred Logue on behalf of NGO Right to Know, The Green News reports.

Ireland has failed to ensure that appeals conducted on AIE requests and associated reviews in the courts are conducted in a “timely manner” under the provisions of the binding convention, which came into force in the State in 2012, according to the document.

The State has until Friday 25 September 2020 to respond to the draft findings before the finalised report is submitting to the meeting of all parties to the Convention in October 2021 for adoption.
