NI: Derry couple lose 'narrowly' in Northern Ireland's first Supreme Court judgment

Derry couple Michael Harkin and Donna McCool have lost their case in the first-ever UK Supreme Court judgment handed down in Northern Ireland.

The five-judge appeal court, led by Deputy President Lord Mance, handed down a majority decision in their appeal against confiscation orders made by Derry Crown Court on 2nd July 2014.

Jack Quigley of Madden & Finucane, solicitor for both appellants, said the couple “narrowly” lost the case.

Mr Quigley (pictured) said: “Mr Harkin and Mrs McCool were today vindicated in bringing their appeals to the highest domestic Court available to them.

“The appellants convinced both Lord Mance and Lord Reed that the confiscation orders made against them at Derry Crown Court were unlawful.

“We shall take time to consider the implications of today’s majority decision from the five Law Lords and consider whether there is merit in an application to the European Court of Human Rights.”
