NI: Brexit case lawyer encouraged by London proceedings

The solicitor representing victims’ campaigner Raymond McCord in his challenge to the Brexit process in the High Court in Belfast has said he is encouraged by separate proceedings concluding in London today.

Ciaran O’Hare of McIvor Farrell Solicitors travelled to London alongside barrister Conan Fegan BL in order to perform a watching brief at the English challenges to the Brexit process.

In proceedings in London, Lord Pannick QC, on behalf of Gina Miller, has argued only Parliament has the power to invoke Article 50 and initiate the UK’s exit from the EU, rather than the Prime Minister.

The proceedings are concluding today.

Mr Pannick today, in his response to the Crown’s case, made the submission that “fundamental constitutional rights will be destroyed if the British Government invokes Article 50 to withdraw from the EU”.

Responding to the proceedings in London, Mr O’Hare said: “In my view, the court has been highly receptive to the points raised by the claimants, which I find encouraging in respect of Mr McCord’s case.”

It is believed that both the English and Northern Ireland challenges may proceed to the UK Supreme Court in early December.

Mr O’Hare explained: “The reason why these cases may proceed to the Supreme Court is that they involve constitutional legal issues of huge importance.”
