Vicky Phelan lawyer says State has ‘aligned with labs’ not women

Solicitor Cian O’Carroll, who has represented CervicalCheck scandal victims including Vicky Phelan, has accused the Government of aligning with the labs at the centre of the scandal.
Mr O’Carroll told the Irish Independent that the Government was not living up to its pledge to stand with the women affected by the failures in cervical cancer screening.
He said negligence was a factor in the “vast, vast majority of cases”, based on an expert review of around 40 cases.
However, the Department has maintained that negligence can only be determined appropriately in court, where no cases have yet been decided.
Three cases have been settled out of court.
Mr O’Carroll said this amounted to the State making “the labs’ case for them”.
