Shannon Airport trespass trial on hold pending Supreme Court ruling

The trial of three activists charged with trespassing at Shannon Airport has been adjourned pending the outcome of a Supreme Court appeal in a separate case.

Áine Ní Thréinir, Aindriú de Buitléir and Eimear Walshe were charged with offences under section 11 of the Criminal Justice (Public Order) Act, 1994 in relation to a protest which took place in March 2024.

The trio — dubbed the “Shannon Three” by supporters — have been on bail for 22 months since their arrest.

Their trial will not now go ahead until the conclusion of a Supreme Court appeal brought by a person convicted of trespassing at Shannon Airport in 2023.

The appeal will consider whether protesters accused of trespassing can rely on the defence of necessity and is likely to impact future trials.

The Supreme Court appeal was brought to the attention of Clare Circuit Court by counsel acting for the State Solicitor for Co Clare.

The three activists’ trial will now be rescheduled pending the result of the appeal.
