Supreme Court to make asylum seekers' right to work declaration in February

The Supreme Court will make a formal declaration next February that the absolute prohibition on asylum seekers looking for employment is unconstitutional, The Irish Times reports.

The court today ruled that a declaration will be made on 9 February 2018, regardless of the State’s progress in addressing the finding.

It follows the landmark ruling in May, in which the Supreme Court found the absolute prohibition on asylum seekers looking for employment in section 9(4) of the Refugee Act 1996 is unconstitutional.

When the judgment was handed down on 30 May, the court agreed to defer making a formal declaration for six months. Today, the State asked the court for a further deferral to March 2018.

The Chief Justice of Ireland, Mr Justice Frank Clarke, said the court had “exceptionally” decided not to make a declaration in May.

He set a date in February and stated that he envisioned no further court hearing concerning the matter.
