Private clamping legislation was delayed by technical error

Legislation to regulate private clamping was delayed due to an error in the enacted legislation.

The Department of Transport’s annual report for 2016 notes that “a technical error” was identified within the Vehicle Clamping Act 2015 last year, meaning the National Transport Authority could not “efficiently commence and conclude the required consultation period on draft Regulations”.

The error relates to section 4 of the Act, which was later amended by section 37 of the Road Traffic Act 2016.

The Department’s report explains: “An amendment was introduced in the Road Traffic Bill 2016 to correct the error and allow for commencement of the Vehicle Clamping Act 2015.

“That amendment was accepted by the Oireachtas and the Road Traffic Act 2016 was signed into law on 27 December 2016 and commenced in April 2017.

“The Department is now working with the Office of the Parliamentary Cousnel in relation to commencing the Vehicle Clamping Act 2015 as expeditiously as possible.”
