Prison inspector in call for independent prisoner complaints investigations

Judge Michael Reilly, Inspector of Prisons, has recommended that prisoner complaints be brought under the remit of the Ombudsman and Information Commissioner, The Irish Times reports.

He makes the recommendation in an unpublished report which has been presented to Justice Minister Frances Fitzgerald.

Judge Reilly said it would create a mechanism for the independent investigation of prisoners’ complaints.

Serious complaints are currently investigated by a team of lawyers appointed by the Irish Prison Service (IPS).

A spokesperson for the Irish Penal Reform Trust (IPRT) told Irish Legal News: “It is crucial that prisoners have access to an external complaints mechanism without fear of potential repercussions within prison.

“To this end, IPRT would welcome proposals to extend access to the Ombudsman and Information Commissioner as a positive step and a pragmatic solution within the current economic environment.

“However, this would depend on adequate resources being provided both financial and in terms of requisite expertise.

“Prisons are places where people live and work, and complaints can range from access to medical treatment right up to allegations of assault.

“It is vital for prisoners and prison staff alike that they have access to an independent body in which all parties have complete confidence.”
