New legislation to introduce minimum sentences for repeat sex offenders

New Government legislation will introduce minimum sentencing for repeat sex offenders.

A private member’s bill brought in by Minister of State Kevin ‘Boxer’ Moran (pictured) is to be adopted by the Government.

It will apply to offenders sentenced to at least five years’ imprisonment. If such a person offends again within seven years they will face a tougher minimum sentence.

Draft laws provides that the minimum period will be three-quarters of the maximum possible term allowed for that crime.

Where maximum imprisonment is life, a minimum sentencing period of 10 years will apply.

Incest laws will also be reformed. Currently, there is a disparity between men and women. Men found guilty of committing incest can face life imprisonment while women face a maximum jail sentence of seven years. The new law will increase this period.

Mr Moran said: “Both issues will be contained in a Government Bill which Minister Flanagan will seek Cabinet approval for in the Autumn.

“I am truly delighted that my original Bill’s proposals are now being taken on by Government.

“I am absolutely delighted that I have been in a position to effect change and the fact that this Bill is now becoming part of Government legislation programme reflects the change that can happen from the Independent Alliance.”
