Man whose evidence was heard in nursing home must stay there

A man who gave evidence to the High Court as it sat in a nursing home for the first time ever has failed to convince the court that he should be allowed to leave, The Irish Times reports.

The man, represented by Dublin firm KOD Lyons and supported by the group Sage Advocacy, was opposing an application by the HSE to have him made a ward of court.

He is in his 60s and has severe epilepsy and brain disease to the point where his doctor feared a court hearing could trigger a seizure.

In a reserved judgment, Mr Justice Peter Kelly, president of the High Court, said the decision could be reviewed in six to twelve months time.

Until further court order, the man will remain in the nursing home where Mr Justice Kelly heard the man’s evidence.

The matter will next come before the High Court on 15 October.
