Fresh cases in cervical cancer smear test controversy lodged at High Court

Fourteen fresh cases involving women who have been affected by a controversy in which they received false negative smear tests have been lodged at the High Court over the past month, The Irish Times reports.

Most cases allege that quicker detections or warnings of cancer could have resulted in earlier intervention, saving the women from unnecessary surgery.

Proceedings have been filed against US labs Medlab Pathology and Quest Diagnostics, which test for the CervicalCheck national screening programme.

Tipperary solicitor Cian O’Carroll has taken on nine of the new cases, also handled the case of Limerick woman Vicky Phelan.

Her settlement at the High Court earlier this year led to the disclosure that the screening programmed had failed to tell numerous women diagnosed with cervical cancer about incorrect smear tests before their diagnosis.

He said: “The common thread in the cases is that there is an expert who has given an opinion that the women had one or more prior smear tests that were significantly under-reported.”
