Former judges to advise Lords EU Justice Sub-Committee

What should the future relationship between the UK and the Court of Justice of the European Union (CJEU) look like? Will the UK still be part of the European Arrest Warrant? Does the EU (Withdrawal) Bill provide legal certainty?

The House of Lords EU Justice Sub-Committee will meet with retired judges on Tuesday to explore the post-Brexit jurisdiction of the CJEU, with the view to launching an inquiry.

Speaking to the Committee at 11.15am will be:

  • The Rt Hon. the Lord Hope of Craighead, convener of the Crossbench Peers, and former Deputy President of the Supreme Court of the United Kingdom

  • The Rt Hon. the Lord Neuberger of Abbotsbury, Former President of the Supreme Court of the United Kingdom

  • The Rt Hon. the Lord Thomas of Cwmgiedd, Former Lord Chief Justice of England and Wales

  • The Rt Hon. Sir Konrad Schiemann, Former judge at the CJEU

    • The committee will question witnesses about topics including:

    • The type of legal arrangements that could exist between the UK and the EU post-Brexit;

    • Whether the EU (Withdrawal) Bill provides sufficient legal certainty;

    • The future relationship between the UK and the CJEU;

    • The UK’s future role in the European Arrest Warrant and other legal mechanisms dependent on EU law;

    • Judicial co-operation and mutual recognition of judgments post-Brexit;

    • Future mechanism for protecting citizens’ rights.
