European Commission instructs Government to ease barrister advertising restrictions

The European Commission has told the Government to ease restrictions on advertising by barristers as “a matter of urgency”, The Irish Times reports.

The Commission launched an investigation in 2013 into whether Irish regulations restricting the ability of barristers to advertise their services are compatible with EU directives.

Section 218 of the Legal Services Regulation Act 2015 provides that “no professional code shall operate to prevent … a legal practitioner from advertising his or her legal services”, but it has not yet been brought into force.

In a letter seen by The Irish Times, a Commission official said it believes the law “should be introduced as a matter of urgency to ensure compliance with EU law of Irish regulations on the matter of advertising by lawyers”.

The Commission issued a reasoned opinion to Ireland regarding the matter in recent days.
